- INTRODUCTION
Platform: “Newbie Learn” is a trademark used by the Swedish private limited company The Newbie Guide To Sweden AB with company reg.no 556934–4905, with address Ballonggatan 5, 169 71 Solna (hereinafter referred to as “Newbie Guide”). The trademark refers to the part of the business engaged in the sale of Digital Products, via the sale channel www.thenewbieguide.se/learn (“Platform”).
Contracting Parties: The following Newbie Guide Terms of Purchase (the “Terms of Purchase”) apply to all individual contracts for the purchase of Digital Products made from the Platform concluded between:
- Newbie Guide, and
- the individual or legal entity who purchases Digital Products through the Platform (hereinafter referred to as the “Customer”).
Newbie Guide and the Customer are referred to collectively as the “Parties” and individually as the “Party”.
Scope: These Terms of Purchase regulate all aspects of the relationship between Newbie Guide and the Customer. Unless otherwise agreed in writing between the Parties, the following terms regarding the Digital Products shall apply. The terms and conditions cover, inter alia, the following matters:
- the purchase of Digital Products;
- provisions regarding fees and payments;
- the handling of complaints and refunds;
- contractual provisions regarding termination, damages, discharge from liability and dispute resolution.
Commitment: The Customer agree to the Terms of Purchase when the Customer completes a purchase on the Platform and undertakes to comply with the terms.
- DEFINITIONS
In addition to the terms defined in the running text of these Terms of Purchase, the following terms used herein shall have the following meaning when they are expressed in capital letters as initial letters, whether used in plural or singular, in definite or indeterminate form:
Digital Products: refers to the Digital Products sold at any time by Newbie Guide via the Platform, such as but not limited to, e-books, digital courses and downloadables.
Payment Service Provider: includes a Third Party who processes, among other things, payments from the Customer or performs invoicing on behalf of Newbie Guide.
Product page: means to a page on the Platform with information about the Digital Product’s price, characteristics etc.
Third Party Producer: means a Third Party that has produced a Digital Product which is, or has been, sold on the Platform.
Third Party: means someone other than the Customer or Newbie Guide.
User: means the individual who has a registered user account to the Platform. The User can be a consumer who purchases Digital Products or an individual acting on behalf of a legal entity who purchases Digital Products through the Platform.
- PRODUCTS SOLD ON THE PLATFORM
Through the Platform, the Customer can purchase:
- Digital Products produced by Newbie Guide; and/or
- Digital Products produced by Third Party Producers (herein after referred to as a “Third Party Producer”).
Regarding Digital Products sold on the Platform that are produced by a Third Party Producer, the product descriptions for such Digital Products, including the content of the Digital Products in question, are provided, and produced by the Third Party Producer. Newbie Guide requires each Third Party Producer to ensure that their Digital Products comply with the product descriptions provided and that their Digital Products does not infringe the intellectual property rights of third parties or otherwise violates applicable legislation.
The content, structure and methods used in Digital Products in the form of digital courses, are subject to a constant process of review and improvement. This means that the digital courses a Customer has purchased through the Platform may be changed after the purchase date, and not be identical to previous digital courses, and whilst they might be materially the same, they may not be identical to the description on the Platform or otherwise in Newbie Guide marketing materials.
By purchasing a Digital Product through the Platform, the Customer acknowledges and agrees that Newbie Guide guarantees a minimum access duration of 12 months for the purchased Digital Product via the Platform. This means that the Customer will be able to enjoy and use the purchased Digital Product during this time. After this period, Newbie Guide reserves the right, at its sole discretion, to remove the purchased Digital Product from the Platform and the Customer’s access to the removed Digital Product will thus cease.
- ORDER
In order to complete a purchase of Digital Products from the Platform, the Customer need to have the right to enter into a contract in accordance with applicable law. This means that the Customer must be at least 16 years old to trade with direct payment for the Customer’s own money or at least 18 years to trade on credit, in order to be entitled to execute the order and conclude the purchase agreement with Newbie Guide. By completing the order, the Customer certifies that the Customer has the right to independently enter into this legally binding agreement with Newbie Guide.
The individual who accepts these Terms of Purchase on behalf of a company or other legal entity that the individual represent (the “Entity”), hereby declares and certifies that the individual has the right and authority to enter into this legally binding agreement with Newbie Guide on behalf of the represented Entity and confirms that the Terms of Purchase become binding between Newbie Guide and the Entity as “Customer”. Newbie Guide does not undertake to verify that the authorized signatory has entered into the agreement on behalf of the represented Entity, it is the individual’s responsibility to confirm that the authority has been decided. The Entity is liable for the breach of the Terms by its employees and/or contracted staff.
In order to complete a purchase of Digital Products from the Platform, the Customer need to create a user account to the Platform.
If the Customer is a legal entity, Newbie Guide will provide the Customer with unique product codes that can be used by individuals chosen by the Customer, in order to purchased Digital Products through the Platform using the product codes which deducts the price from the order (since the Customer will conduct the payment through payment of an invoice issued by Newbie Guide). Each such individual must create a user account to the Platform in order to conduct the purchase. The Customer is responsible for sharing the product codes to the individuals in question. The product codes must be entered in connection with the order of the Digital Products on the Platform.
The User is responsible for providing correct contact and delivery information in connection with the purchase. Newbie Guide cannot be held liable for incorrect registered information by the User.
When the Customer has completed the order, the Customer will receive an order confirmation by email confirming that Newbie Guide has received the Customer’s order. If the Customer has not received an order confirmation after the order has been made, the Customer should first check the spam folder and then contact Newbie Guide if necessary.
The order confirmation does not mean that a binding agreement has been entered into. A binding agreement is only entered into when the Customer receive the final delivery confirmation. Before the Customer receive the final delivery confirmation, the Customer’s order may be refused.
In the delivery confirmation, the Customer will find details of the purchase, including the link to the purchased Digital Product(s), the price, any fees, and billing details. If the Customer discovers any error in the delivery confirmation, the Customer must immediately contact Newbie Guide by e-mail: hello@thenewbieguide.se.
Newbie Guide does not apply a return purchase or exchange right. All sales are final, and no refunds will be issued, unless otherwise expressly stated or follows by mandatory legislation.
Newbie Guide reserves the right to receive any printing errors on the Platform, such as incorrect product information or clearly incorrectly stated price.
The Customer is welcomed to contact the Newbie Guide, if the Customer have any questions about these Terms of Purchase or the Customer’s order. Newbie Guide can easily be reached through by writing an email to hello@thenewbieguide.se.
By approving the Terms of Purchase, the Customer declares that the Customer has taken part of the information stated in the terms. By approving the Terms of Purchase, the Customer also approves Newbie Guide’s access to, and handling of all information created or made available by the User on the Platform.
Additional conditions other than those provided in these Terms of Purchase may apply to certain Digital Products and will in such case be provided on the Product page. Such additional conditions shall be considered to be an integral part of these Terms of Purchase.
Supplemental terms provided in writing to the Customer by Newbie Guide shall prevail over these Terms of Purchase in the event of a conflict between the conditions.
- PRICES
The prices indicated on the Platform apply when ordering. All prices include applicable VAT and are stated in Swedish crowns (SEK).
All fees and/or prices available on the Platform and/or in other marketing material provided by Newbie Guide and are subject to change. However, Newbie Guide is not entitled to raise the price for Digital Products for Customers that have already purchased the Digital Products.
If the price or information for a Digital Product listed on the Platform is incorrect and the Customer realized or should have realized this at the time of ordering, the price or information will not apply to the purchase. In such cases, Newbie Guide will contact the Customer as soon as possible after Newbie Guide have detected the error in question.
- PAYMENT TERMS
The Customer is responsible for ensuring that the account to be debited belongs to the Customer and that it contains sufficient funds to cover the agreed price of the purchase.
Payment is made through the Platform by any of the available payment methods.
Newbie Guide engages external payment providers to enable the Customer to pay for the Digital Products sold on the Platform. The Customer is hereby informed that the Customer accepts the Payment Service Provider’s terms and conditions when the Customer makes a payment through the Payment Service Provider’s payment service. The Customer undertakes to review and approve eventual separate terms given by such external payment providers.
Together with Newbie Guide’s payment service provider Klarna, Newbie Guide offer several different payment options. Depending on the payment option the Customer chooses, the Customer will enter into a separate payment agreement with Klarna in connection with the Customer’s purchase. Depending on the payment option the Customer choose, additional costs may also apply.
The Customer do not need to have a Klarna account to be able to pay. Complete the purchase directly with invoice, VISA, MasterCard, and the Swedish banks Swedbank, SEB, Nordea, Danske Bank, Handelsbanken, Länsförsäkringar, Skandiabanken and Sparbanken Syd. Klarna maintains high security requirements and for all card payments, 3D-secure technology is used. Several million people have used Klarna, which is a well-known payment solution on the internet since 2004.

- OFFERS AND DISCOUNTS
Discounts cannot be redeemed for cash or be combined with other offers. This applies unless explicitly stated otherwise. Discount offers are valid for a limited period of time and can only be used if the discount code is entered within the period of validity and prior to the completion of the order. Furthermore, it is possible to only use discount codes one (1) time per order, unless otherwise stated.
Any offers and promotions advertised on the Platform or in Newbie Guide’s advertisements are valid as long as long as they are published, unless other terms are stated in connection with the offer. Any special promotional terms and conditions apply only for the duration of the promotion. The provisions of this paragraph shall apply unless otherwise expressly stated in connection with the promotion or offer.
- RIGHT OF WITHDRAWL
The Swedish Act on Distance Contracts and Off-Premises Contracts (SFS 2005:59) on distance and off-premises contracts (“Distance Contracts Act”) contains provisions that govern consumers’ right of withdrawal when purchases are made at a distance. Customer as a trader has no right of withdrawal under the law.
The right of withdrawal means that the consumer may have the right to withdraw from the sales contract within the withdrawal period without giving any reason, provided that the conditions for the right of withdrawal are met. The withdrawal period is 14 days. Upon purchase of a service, the withdrawal period begins on the day you entered into the contract. When purchasing a product, the withdrawal period starts from the day you received the product.
The following shall apply when purchasing a Digital Product from the Platform:
Under Chapter 2, Section 11, point 11, of the Distance Contracts Act, the right of withdrawal does not apply to contracts for the supply of digital content by any means other than on a physical medium, if the supply has commenced and the consumer has expressly consented to the commencement of the supply and agreed that there is no right of withdrawal and the consumer has received a confirmation of the contract.
The contract for the purchase of Digital Products concluded between Newbie Guide and the Customer, relates to the supply of digital content by any means other than on a physical medium and the supply is made immediately in connection with the payment made.
By completing the purchase of Digital Product through the Platform, the Customer expressly agrees that the supply commences and accepts that there is therefore no right of withdrawal.
- COMPLAINTS
If the Customer wishes to issue a complain regarding a Digital Product, the Customer can contact Newbie Guide through by email.
The Customer is aware that certain Digital Products offered on the Platform may be provided by Third Party Producers. Questions or claims regarding Third Party Producers Digital Products may be directed directly towards the Third Party Producer of such Digital Product.
The Customer must define, when making the complaint, and, if necessary, also show, how the circumstance of the complaint is manifested.
If the Customer complains about the Digital Product and provides the requested documentation, Newbie Guide, or if applicable the Third Party Producer, will investigate the complaint and notify the Customer by e-mail within a reasonable time (normally within 30 days) if the complaint can be accepted and inform about the planned remediation process. Should Newbie Guide find that the Customer is entitled to a full or partial refund due to the complaint, repayment will be made as soon as possible. The payment method is the same as the Customer has used for the purchase unless the Parties have expressly agreed otherwise.
The complaint must be sent within a reasonable time after the Customer has noticed or should have noticed the fault. Notice of reliance on defects by complaint made within two (2) months after the Customer has noticed the defect is deemed to have been made in due time.
If it is found that the Digital Product in question is not defect or faulty in accordance with applicable law, the complaint will not be approved.
- RESTRICTIONS, RESPONSIBILITIES ETC.
The Customer agrees to not:
- license, sublicense, sell, transfer, or in any way distribute or commercialize educational materials, parts thereof or other content provided via Newbie Guide or to modify or make derivative works based upon such materials or content or remove any copyright or other proprietary notices contained in the content, material or information;
- damage any property belonging to Newbie Guide, other customers, Users or third parties;
- cause nuisance, impair collaboration with or between other customers or Users, disturb the possibilities to provide a high quality education, or in any other way show serious disruptive behavior;
- impair the proper operation of any networks used during the provision of Digital Products;
- launch any automated program or script on or from the networks used, including, but not limited to, web robots, bots, viruses or worms, or any program which may make multiple server requests per second, or unduly burdens or hinders the operation and/or performance of any network where applicable;
- send or store material containing software viruses, trojan horses, worms, or other harmful computer code, scripts, files, agents, or programs via used networks;
- on or from the network send spam or otherwise duplicative or unsolicited messages in violation of these Terms of Purchase and/or applicable laws;
- attempt to gain unauthorized access to parts of the Platform that are unauthorized; or
- try to harm Newbie Guide, it’s brand or services, other customers or users or Third Party Producers in any way whatsoever.
The Customer shall compensate Newbie Guide for any damage Newbie Guide incurs due to the Customer’s (and/or if applicable, its User’s) breach of these Terms of Purchase or applicable law.
The Customer is responsible for all activities carried out by the Customer (and/or if applicable, its User’s) and for all information or material produced or made available by the Customer (and/or if applicable, its User’s) through the Platform. The Customer is also responsible for ensuring that all such information or material does not infringe the rights of third parties or violates applicable law and shall indemnify and hold Newbie Guide harmless in the event that the Customer’s (and/or if applicable, its User’s) actions result in a liability for compensation in relation to third parties.
If the User does not respect the obligations set out in these Terms, Newbie Guide reserves the right to suspend or exclude the User from the Platform without any right for the Customer to receive any refund on the fees for the purchased Digital Products and will notify the Customer thereof.
Before any suspension or exclusion, Newbie Guide may first initiate a discussion with the Customer informing the Customer of the issues at hand and providing a written warning to the Customer (and if applicable, the User) that repeated breach may cause suspension or exclusion.
- PERSONAL DATA
Newbie Guide processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC and the Swedish law (2018: 218) with supplementary provisions to the EU data protection regulation (jointly referred to as “GDPR”.
The User is hereby referred to Newbie Guide’s privacy policy for more information regarding Newbie Guide’s personal data processing and adherence to the GDPR.
- LIMITATION OF LIABILITY
Even if Newbie Guide aims to deliver the highest quality in its Digital Products, the Digital Products are provided “as is” and Newbie Guide disclaims all representations and warranties, implied or express, with regard to any results from using a Digital Product and/or taking a digital course.
Newbie Guide is not responsible, and shall not be held responsible, for:
- any damage caused by the User’s incorrect provided information or handling of the Platform;
- the Customer’s inability to use all or part of the Platform, if caused by the Customer’s delay in cooperating with Newbie Guide in time to provide the services (such as providing Newbie Guide with access to, accurate information and materials reasonably necessary for the provision of the services and to perform troubleshooting as necessary);
- failure in performance or delay with regards to a Digital Product resulting from causes beyond Newbie Guide’s reasonable control; or
- errors or interruptions in the Platform if caused by:
- attacks, such as viruses or other security attacks;
- errors in the User’s IT environment/hardware, which are not provided by Newbie Guide;
- other circumstances for which the User is responsible; or
- errors, delays, or damages arising from Third Party applications, plug-ins, services or similar that are not controlled or operated by Newbie Guide.
Newbie Guide is not responsible for the communication that takes place between Users or between the User and Third Party Producers, nor for the information or material that the User makes available through the digital courses or the Customers’ actions and conduct in general.
Newbie Guide can also not be made responsible for any actions or services performed by any Third Party service providers that may negatively impair the User’s experience of the Digital Product. Newbie Guide does not assess the suitability, legality or ability of any Third Party providers and the Customer (and if applicable, the User’s) expressly waive and release Newbie Guide from all liability, claims or damages arising from, or that are in any way related to any Third Party service providers. Newbie Guide will not be a party to disputes or negotiations between the Customer or User and such Third Party service provider.
Also, Newbie Guide shall not be liable for any damages, losses, costs or liability arising out of the Customer’s (and if applicable, its User’s) use of knowledge or skills gained from any Digital Product.
Newbie Guide shall neither be liable for failure in performance or delay with regards to a Digital Product resulting from causes beyond Newbie Guide’s reasonable control.
The Customer is only entitled to compensation from Newbie Guide for proven and reasonable costs incurred as a direct result of negligence on Newbie Guide’s part. Newbie Guide will only reimburse the Customer for indirect costs, damages, or losses (e.g., loss of profit or other consequential damages), if Newbie Guide has acted intentionally or grossly negligently.
Newbie Guide hereby limit its liability for damages to the Customer to the extent permitted by applicable Swedish law.
The limitations and disclaimer in these Terms do not purport to limit liability or alter the Customer’s rights as a consumer that cannot be excluded under applicable law.
The pricing of the Digital Products reflects the risk sharing between Newbie Guide and the Customer, which is an essential part of the basis of the commercial contractual relationship between the Parties. If applicable law does not permit any of the limitations or exceptions governed by these Terms of Purchase, Newbie Guide’s liability in such cases shall be limited to the fullest extent possible under applicable law.
While Newbie Guide endeavors to update and ensure that the information contained in the Digital Products, on the Platform or in other marketing material is correct, Newbie Guide makes no representations, warranties, or guarantees, whether express or implied, as to the accuracy, completeness, currency, or reliability of any of them.
Any claim or request for compensation due to damages in accordance with the Terms of Purchase must be made to Newbie Guide within a reasonable time from the time the damages were discovered or should have been discovered (normally within 30 days).
- FORCE MAJEURE
With the exception of events where a Party has acted grossly negligently or intentionally, such Party shall be exempt from liability for breach of the Terms of Purchase and/or sanction as a result of failure to fulfill obligations under the Terms of Purchase due to circumstance that hinder or significantly impede or delay performance.
Such a circumstance is, for example, war, terrorist attack, authority regulation, action or omission, labor market conflict (even where the Party does not itself participate in the conflict), blockade, fire, restrictions on energy supply, flood or other natural disaster or accident of greater magnitude or other circumstances outside of a Party’s control, which the Party reasonably could not have foreseen and whose consequences the Party could not have reasonably avoids or overcome.
A Party wishing to invoke such a circumstance shall without delay inform the counterparty in writing of the occurrence or cessation of the circumstance.
- INTELLECTUAL PROPERTY RIGHTS
Newbie Guide or its licensors own all intellectual property rights, including but not limited to rights concerning copyright, trademarks, trade names, design, text, software, etc., related to the Platform, Digital Products, and its content.
Newbie Guide does not transfer or assign any intellectual property rights to the Customer, User or anyone else in connection with the Terms of Purchase. The Customer (and/or if applicable, its User’s) may not copy, reproduce or commercially exploit Newbie Guide or its licensors intellectual property rights.
The Customer and/or User is not entitled to use images, texts or other material belonging to Newbie Guide or its licensors for commercial purposes, without Newbie Guide’s prior written consent.
Breach of the above provisions is considered a material breach of contract.
Nothing in the Terms of Purchase shall be construed as if any of these rights being wholly or partly transferred to the Customer or any User. Any copying, modification, transfer, licensing and/or other use of the Digital Products other than that allowed under these Terms of Purchase is prohibited.
The Customer (and if applicable, its Users) understand that the unauthorized use of Newbie Guide’s intellectual property rights or rights from Third Party Producer’s Digital Products constitutes a breach of contract and may constitute a criminal action. Newbie Guide has the right to take legal action against the Customer in the event of such unauthorized use of the aforementioned intellectual property rights.
The Customer retains ownership to all content submitted by the Customer (and if applicable, its User’s) to Newbie Guide (or a Third Party Producer), such as text, files, images, photos, videos, or other works of authorship, and warrant that such content does not infringe on any Third Party rights and will indemnify and hold Newbie Guide harmless from all damages and costs in case of infringements of Third Party rights. The Customer hereby grants to Newbie Guide a global, non-exclusive, irrevocable, perpetual, royalty-free license to use all such submitted content in Newbie Guide’s marketing and sales, including without limitation the right to publicly perform, reproduce, display, modify, manage, distribute and store any of such content as part of the Platforms or as part of any materials used to promote or advertise Newbie Guide anywhere in the world.
The stated rights shall apply for all media and formats without cost, perpetually and on a global level. The Customer confirm that the Customer (and if applicable, its User’s) do not have any right to fees or remuneration and that the Customer shall not seek to enforce any rights whatsoever to remuneration or fees in respect of all content submitted by the Customer’s (and/or if applicable, its User’s).
- COMMUNICATION
The Customer agrees that Newbie Guide, including Third Party Producers that have produced the Digital Products that the Customer has purchased, transmits information, documentation and documents relating to the purchase by e-mail or other form of electronic communication that Newbie Guide deems appropriate to the contact details provided by the Customer (an/or if applicable, the User) in connection with the order.
The Customer undertakes to state the current and valid email address to which the Customer (and if applicable, its User’s) wishes the communication to be sent when completing a purchase and/or making a complaint and/or claim.
The Customer further undertakes to immediately notify Newbie Guide of any updates regarding the Customer’s (and/or if applicable, its User’s) contact information.
- CHANGES
Appearance of the Platform: Newbie Guide has the right to modify the content, appearance, etc. of the Platform at any time and at its own discretion, without prior notice. This applies even if such changes result in a change in the user experience. In such cases, the Customer is not entitled to any compensation from Newbie Guide on the basis of such a decision.
Services: Newbie Guide has the right, at any time and at its discretion, to offer new services, to modify the range of its services and to cease the provision of its services, including the Platform.
Changes in conditions: Newbie Guide reserves the right to modify and/or add to the Terms of Purchase at its own discretion.
If amendments and/or additions to these Terms of Purchase (a) are the result of a change in law, regulation or administrative decision, or (b) consist of minor amendments and/or additions made for administrative, technical or safety reasons and do not impair the Customer’s rights under the Terms of Purchase, they shall enter into force with immediate effect after the updated Terms of Purchase are published on the Platform. It is the Customer’s responsibility to keep up to date regularly with the applicable Terms of Purchase that are published on the Platform.
In the case of amendments and/or additions to the Terms of Purchase other than those described above, these will be notified to the Customer in the manner decided by Newbie Guide no later than thirty (30) days before their entry into force. If such a change of conditions is of substantial importance to the Customer, the Customer shall be entitled to terminate its User Account so that it expires on the date on which the amendment enters into force. If the Customer does not terminate its User Account before the amendments enter into force, the Customer shall be deemed to approve them.
Newbie Guide also has the right to, at any time and without prior notice, change how the Digital Products are provided.
Newbie Guide also has the right to implement updates, develop, improve, and modify the Digital Products to such an extent as Newbie Guide deems necessary or appropriate. Such changes may result in some of the Digital Products’ content being changed, terminated or added.
- MISCELLANEOUS
The Customer may not assign or delegate any of its rights or obligations under these Terms of Purchase.
Newbie Guide always has the right to assign its rights and obligations under these Terms of Purchase to such Third Party that procures Newbie Guide’s business, without the Customer’s prior consent.
If Newbie Guide fails to insist that the Customer performs any of its obligations under these Terms of Purchase, or if Newbie Guide does not enforce its rights against the Customer (and/or if applicable, its User’s), or delay in doing so, that will not mean that Newbie Guide has waived its rights against the Customer (and/or if applicable, its User’s), and does not imply that the Customer (and/or if applicable, its User’s) do not have to comply with those obligations. If Newbie Guide does waive a default by the Customer, it will only be made in writing, and does not imply that any later default by the Customer is thereby automatically waived.
If any provision of Terms of Purchase is found in whole or in part to be unenforceable or invalid by the Swedish General Court, Arbitration Board, or the National Board for Consumer Disputes (ARN), it shall not invalidate the terms and conditions in their entirety. Instead, the relevant provision in other parts and all other provisions shall be in force and to the extent that invalidity affects a Party’s rights or obligations, reasonable adjustment shall be made.
The provisions of the Terms of Purchase relating to intellectual property rights, dispute settlement and any other provisions which, expressly or in view of its nature, are intended to apply even after the fulfillment or termination of the purchase agreement shall continue to apply even after the fulfillment or termination of the purchase agreement.
- APPLICABLE LAW AND DISPUTES
These Terms of Purchase and any dispute, controversy or claim arising out of or in connection with the agreement entered between the Parties or its subject matter or formation, or the breach, termination, or invalidity thereof, shall be governed by and construed in accordance with the laws of Sweden.
Disputes that arise between Newbie Guide and a Customer in its capacity of a consumer may be referred to the National Board for Consumer Disputes (“ARN”) (www.arn.se, postal address: Allmänna Reklamationsnämnden Box 174, 101 23 Stockholm), which offers an alternative dispute resolution for consumer disputes or other authority with the competence to handle the dispute. In addition, the consumer can lodge complaints online through the European Commission’s Digital Dispute Mediation Platform (EU ODR) via the following link: ec.europa.eu/consumers/odr. The customer also has the right to contact the Consumer Ombudsman (www.ko.se).
If Newbie Guide and the consumer in question do not arrive at a solution to the dispute through any alternative dispute resolution method, the dispute may be tried and finally decided by a general court in Sweden, unless otherwise follows from mandatory legislation.
Newbie Guide and the Customer in its capacity of a legal entity/trader hereby irrevocably agrees that a) these Terms and its interpretation shall be governed by the laws of Sweden, except for its rules and principles concerning the choice of law, and b) the courts of Sweden shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims), arising out of or in connection with these Terms of Purchase and any dispute, controversy or claim arising out of or in connection with the agreement entered between the Parties or its subject matter or formation, or the breach, termination, or invalidity thereof.
Disputes that arise between the Customer/User and other customers or users, or between the Customer/User and a Third Party Producer or other Third Party, shall be resolved between the disputing parties.
